Oh My Software FZCO ("us", "we", or "our") operates the CarOS mobile application (hereinafter referred to as the "Service").

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

Definitions

• Service is the CarOS mobile application operated by Oh My Software
• Personal Data means data about a living individual who can be identified from those data
• Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself

Information Collection and Use

We collect several different types of information for various purposes to provide and improve our Service to you.

Personal Data: While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. This may include email address, first name and last name.

Usage Data: When you access the Service by or through a mobile device, we may collect certain information automatically, including the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, and other diagnostic data.

Live Trip Sharing: When you share a trip, CarOS sends your position and heading to our server every few seconds while the app is open on screen, and the server keeps the route travelled since the start of the share. With CarOS Premium, CarOS can also send your destination, your estimated arrival time, and the trip distance, duration and average speed; you can turn these details off in the app. Anyone who has the link you send can see this information on a web page, without an account. The link is random and cannot be guessed, and only your iPhone can add positions to it.

A share ends when you stop it, when you arrive, or at the latest 12 hours after it started. When it ends, your position, route and trip details are erased from our servers (shortly afterwards for a share that simply expires). The link then only shows that the trip has ended and at what time, for 30 days, after which the share is deleted entirely. We also keep the identifier of the app installation that created the share, only to prevent abuse; it is deleted with the share. Shared positions are never used for any other purpose, never sold and never given to third parties. The map on the sharing page is provided by Apple (MapKit JS): the browser of the person viewing it loads map data from Apple.

Face Control Feature

FaceControl is a feature available on compatible devices with a TrueDepth camera system. This feature allows you to control the playback of your device by making movements with your mouth, without touching the device.

The camera images and resulting depth data are only used for this feature and can be activated and deactivated at any time inside the app. The live video feed is never used, and its data is never stored locally or remotely.

Face data is never stored remotely, given to third parties, or used for any non-FaceControl purposes. The face data only remains on your device, and never leaves your device at any time.

When you buy CarOS Premium on our website, payment is handled by Stripe: we never see your card details. We receive your email address, name, country and the amount paid, to send your activation code, create or update your CarOS account, and handle refunds.

Advertising Measurement

Our website uses the Meta Pixel, and our server reports completed purchases to Meta (Conversions API), to measure how well our ads work. What we send is limited to the purchase (product, amount, currency), your email address and country in hashed, irreversible form, your IP address and browser, and the ad click identifier when you came from a Meta ad. We do not sell your data. In the European Union and the EEA, the United Kingdom and Switzerland, the pixel only runs after you accept it; elsewhere it runs unless you turn it off. You can change your choice at any time with the “Cookies” link at the bottom of every page, and manage your ad preferences in your Meta account.

Premium Offer Statistics in the App

CarOS counts on your iPhone how often the Premium offer is shown, where it was opened from and which offer is tapped, and sends these counts at most once a day as anonymous totals, with no device or account identifier.

Children's Privacy

Our Service does not address anyone under the age of 18 ("Children"). We do not knowingly collect personally identifiable information from anyone under the age of 18.

These Terms and Conditions govern your relationship with CarOS mobile application (the "Service") operated by Oh My Software ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms.

Key Points

Road information prevails: The information provided by the Service is not intended to replace the information provided on the road, such as travel direction, time based restrictions, lane restrictions, road blockades, traffic signs, traffic lights, police instructions, etc.

Cautious driving: Always drive vigilantly according to road conditions and in accordance with traffic laws. It is strictly forbidden to interact with the Service while driving except through voice commands.

Subscriptions

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it.

Free Trial

CarOS may offer a Subscription with a free trial for a limited period of time. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees.

Refunds

Except when required by law, paid Subscription fees are non-refundable.

Account Creation

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Russian Federation, without regard to its conflict of law provisions.
